We are taking a phased approach to ensure the smooth delivery of this new system and to allow sufficient time for everyone to adapt. Our broad approach for January 2021 will be to open existing routes that already apply to non-EU citizens, to EU citizens (the current ‘Tier 5’). The points-based system will provide significantly greater flexibility for skilled workers wishing to come to the UK. The requisite salary thresholds and skill levels will provide employers with greater scope to employ skilled migrants from overseas. Additionally, in line with the recommendations from the MAC, we will create a broader unsponsored route within the points-based system to run alongside the employer-led system.

Lawyers and NGOs claimed that the legal process “could take years” rather than months. We will apply this to everyone seeking to come to the UK, wherever they are from. Currently, EU citizens are subject to different thresholds for criminality than those from the rest of the world. Existing UK rules for non-EU citizens are both stricter and more specific. The application of the current EU public policy test is less certain and predictable in practice than we would like. We will not be creating a dedicated route for self-employed people. We recognise that there are several professions where there is a heavy reliance on freelance workers.

This practice is prohibited by Article 3 of the European Convention on Human Rights, which forms part of UK law as part of the Human Rights Act 1998. In 2017, the Home Office under Amber Rudd deported a refugee back to Afghanistan in spite of a High Court order not to, was found in contempt of court and on review was ordered to return him. Kenneth Baker was found in contempt of court when his Home Office did the same thing in 1991.

A 2018 governmental review revealed that the Home Office had tried to deport at least 300 highly skilled migrants under the 322 provision, at least 87 successfully. This mostly affected people who had lived in the UK for more than 10 years and had children born in the UK. Many were given only 14 days to leave the UK and were made ineligible to apply for visas to return. The review found that 65% of 322 decisions were overturned by an upper tribunal and 45% of applicants for judicial review were successful (28% of judicial reviews found in favour of the defendant). Additionally, the review found that 32% of "complex cases" were wrongly decided. Under the current immigration rules, there are a range of other immigration routes for specialist occupations, including innovators, ministers of religion, sportspeople and to support the arts.

The committee said it was not convinced that the department was sufficiently prepared to properly safeguard the existing, immigrant population in the UK legally, while also implementing a new immigration system and responding to the Covid-19 pandemic. The report said that despite “years of public and political debate and concern”, the department still did not know the size of the population in the UK illegally. Officials were questioned by MPs about the department’s “compliant environment” policy, which limits access to work, housing, benefits and other government-funded services. The committee was examining the role and function of Immigration Enforcement. This is the directorate within the department responsible for preventing abuse of the immigration system, in light of a critical National Audit Office report, which was released in June. Home Secretary and European counterparts meet to renew discussions on how to crack down on illegal migration and people trafficking.

All I’d say there is that implementation has to be high on the list when designing policy, whereas I’d be surprised if you ever reach review stage – this doesn’t seem to happen very often. The people issuing visas, Border Force and other operational and policy people with an interest. I hope any conversation on short-term visas also covered the risks of exploitation, although that risk may be lower for drivers. Some of the report examined the legacy of the Windrush scandal, and concluded that the internal culture that created the hostile environment still remains.

This policy statement is accompanied by an engagement and consultation process that will run for 6 weeks from 24 March 2021. More detailed analysis on the points-based system and individual routes will be published shortly. The MAC modelling gives a broad overview of impacts but does not include detailed eligibility rules within each route – for example the impact of any additional fees or changes to administration costs which will affect behaviour.

Step Up Migrant Women Campaign, a coalition of dozens of organisations working with migrant victims of domestic abuse, was formed in response to this trend. The policy has been cited as one of the harshest immigration policies in the history of the United Kingdom, and has been widely criticised as inhumane, ineffective, and unlawful. The United Nations Human Rights Council has stated that the policy has fostered xenophobia within the UK, while the Equality and Human Rights Commission has found that the policy broke equalities law. Robert Jenrick, the immigration minister under Braverman, appeared to signal a much tougher approach in an interview with GB News on Saturday, saying he wanted to created a system “where deterrence is suffused through the whole thing”.

From 1978 to 2004, the Home Office was then located at 50 Queen Anne's Gate, a Brutalist office block in Westminster designed by Sir Basil Spence, close to St James's Park tube station. Many functions, however, were devolved to offices in other parts of London, and the country, notably the headquarters of the Immigration and Nationality Directorate in Croydon. Aderonke Apata, a Nigerian LGBT activist, made two asylum claims that were both rejected by the Home Office in 2014 and on 1 April 2015 respectively, due to her previously having been in a relationship with a man and having children with that man.
